Terms and Conditions:

We will prepare a report for your sole and exclusive use as the Lender/Client.  If not already done, our standard property disclosure form will be faxed or emailed to the borrower as soon as we make contact with them.  If the appraisal appointment is not indicated above then we will attempt to contact the borrower within 24 hours.  We will furnish you with a full color copy of the appraisal via email in PDF format.  If you have not already done so please supply your email address below.  If PDF is not acceptable then $50.00 will be added for printing and shipping costs.

The appraisal fee indicated above will be paid (within 15 days of invoice) or will be (Collect from Borrower at the door).  If not indicated on your order then it shall be assumed that the Lender/Client will pay within the invoice in full within 15 days of receipt of appraisal and invoice.

TERMS and CONDITIONS.  The purpose of this appraisal is to estimate the market value of the property.  All assumptions and limiting conditions in the written report shall apply (samples available for review upon request).  The legal property appraised would typically be fee simple interest (unless specifically ordered otherwise).  The property will be valued as of the effective date shown on the appraisal.  The appraisal will be prepared in accordance with the Uniform Standards of Professional Appraisal Practice.  On any order now or in the future that is requested "COD Borrower at the Door" we will require the borrower to pay in full at the time of the initial inspection and it is further agreed that we may at our option supply the borrower directly with one copy of the appraisal report.  It is further agreed that in the case of any dispute regarding this assignment or fee, in all cases the jurisdiction and venue shall be Thurston County, Washington State regardless of the client's in or out of state address.  Laws of the State of Washington shall govern in all cases.  Limit of liability of the appraiser is return of any fees actually paid to the appraiser.  Persons ordering services shall be personally responsible for payment as well as any corporate entities named on the order or confirmation.  These terms and conditions will continue in force on future assignments until cancelled by both parties in writing.  In the event of non-payment per our terms, the parties agree that the appraiser  is granted automatic lien rights on subject property and clients (and any assignees) lien shall automatically subordinate to appraiser's lien.  Further said lien shall attach to all escrow or trust accounts for all monies owed.  Late fees are 5% per month until paid including pre and post-judgment.  Appraisal assignments are not conditioned on minimum value, comp checks or direction in value or condition.  Cancellation prior to site visit is 25% min. and after site visit, missed appointments, additional comps/inspections are min. 50% of appraisal fee..  If lawsuit is filed to compel payment appraiser  is entitled to a minimum $500.00 legal / processing / appearance fee above amounts owed and in addition to actual attorney fees.  We do not carry E&O Insurance as it is not required in Washington State. These terms and conditions supersede and are in addition to those on the appraisal order.  Appraisal report shall be completed within 30 days or less of acceptance of this confirmation notwithstanding acts of God.  Any delays caused by appraiser waiting for information from client or borrower, power outages, or declared state of emergency shall extend completion date by same number of days.  Appraiser shall have the right of offset against other checks, invoices or monies owed.  In the event of non-payment by borrower on any COD appraisal fee the Lender/Client shall be responsible for payment in full within 15 days of notice given for nonpayment or insufficient funds.  Lender/Client certifies to appraiser that they are fully and completely licensed in the State of Washington as required by Washington State Law.  If any part of this agreement is found to be invalid only that part shall fail and the remainder shall survive.

It helps expedite the appraisal process if you fax / email us full copy of title report, legal description & plat map.  The following items are needed so that we can complete the appraisal in a timely manner.  Please fax them (or better yet email them as email copies come through much clearer) as soon as possible.

ý         Complete copy of Purchase & Sale Agreement with all Addendums (sales only).

 

ý         Complete copy of construction contracts, plans, specs on all new construction.

 

ý         Complete copy of the Seller's Property Disclosure Form (Form-17 on sales only).
